Context

  • The Supreme Court in Colorado ruled that Donald Trump is “disqualified from holding the office of President” under Section 3 of the 14th Amendment of the US Constitution.

What is the 14th Amendment of the US Constitution?

  • The Fourteenth Amendment (Amendment XIV) to the United States Constitution was adopted on July 9, 1868, as one of the Reconstruction Amendments.
  • Usually considered one of the most consequential amendments, it addresses citizenship rights and equal protection under the law and was proposed in response to issues related to formerly enslaved Americans following the American Civil War.
  • The amendment limits the actions of all state and local officials, and also those acting on behalf of such officials.
  • The amendment's first section includes several clauses: the Citizenship Clause, Privileges or Immunities Clause, Due Process Clause, and Equal Protection Clause.
  • Section 2: Apportionment of Representatives
  • Section 3: Disqualification from office for insurrection or rebellion.

Section 3 disqualifies from federal or state office anyone who, having taken an oath as a public official to support the Constitution, subsequently has "engaged in insurrection or rebellion" against the United States or given "aid and comfort" to its enemies.
